  1. ACCEPTANCE OF TERMS

By accessing and using this website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or purchase our products.

  1. ABOUT OUR ARTWORK

All Products Are Original:
Every piece of artwork sold through Pranka Art is an original, one-of-a-kind creation by artist Maria Pranka. No two pieces are identical.

Handmade Nature:
All artwork is handmade using various techniques including:

  • Alcohol ink
  • Acrylic pouring
  • Mixed media
  • Other fluid art techniques

Natural Variations:
Due to the handmade nature of our artwork, slight variations in color, texture, and appearance are inherent to the artistic process. These variations are part of the artwork’s unique character and are not considered defects.

Some techniques (particularly alcohol ink and fluid art) may create effects that appear irregular, unpredictable, or uneven. These effects are intentional and represent the artistic style, not damage.

  1. PRICES AND PAYMENT

Currency:
All prices are displayed in EUR (Euro) and include Latvian VAT where applicable.

Pricing:

  • All prices include VAT/taxes
  • Prices are subject to change without notice
  • The price at the time of order placement applies
  • Shipping costs are calculated separately at checkout

Payment Methods:
We accept the following payment methods:

  • PayPal
  • Stripe (credit/debit cards)
  • Google Pay
  • Bank transfer (by arrangement – contact us)
  • Cryptocurrency (by arrangement – contact us)

Payment Timing:
Payment is charged immediately upon order placement. Your order will be processed once payment is confirmed.

No Hidden Fees:
We do not charge any additional processing fees at checkout. The price you see is the price you pay (plus applicable shipping).

  1. ORDERS

Order Confirmation:
Once you place an order, you will receive an email confirmation. This confirms that we have received your order but does not constitute acceptance of your order.

Order Acceptance:
We reserve the right to accept or decline any order. Your order is accepted when we send you a shipping confirmation email.

Sold Items:
All artwork is unique and available while supplies last. If an artwork is sold before your order is processed:

  • We will notify you immediately
  • Your payment will be fully refunded
  • We cannot offer a replacement as each piece is one-of-a-kind
  1. INTELLECTUAL PROPERTY AND COPYRIGHT

Copyright Ownership:
All copyright and intellectual property rights in the artwork remain with Maria Pranka (the artist), even after purchase.

What You Purchase:
When you purchase artwork, you are purchasing the physical piece only. You do not acquire any intellectual property rights.

Personal Use:
You may photograph the artwork you purchase for personal, non-commercial purposes only, including:

  • Displaying photos in your home
  • Sharing photos on personal social media
  • Showing friends and family

Prohibited Uses:
You may NOT:

  • Reproduce the artwork commercially
  • Create prints, copies, or reproductions for sale
  • Use images of the artwork for commercial purposes
  • Claim the artwork as your own creation
  • License or sublicense the artwork to others
  1. CUSTOM COMMISSIONS

Availability:
We accept custom commissions on a case-by-case basis.

Important Limitations:

  • We do NOT copy other artists’ work
  • We do NOT create reproductions of existing artwork
  • We do NOT paint specific subjects that don’t align with our artistic style (e.g., “pink unicorns”)

Commission Process:

  • Commission involves creating original artwork in colors/themes you specify
  • The final composition remains the artist’s creative expression
  • The artwork will reflect Maria’s style and current artistic mood

Commission Terms:

  • 50% non-refundable deposit required upfront
  • Balance due before shipping
  • Completion timeframe: up to 30 days from deposit
  • NO revisions – the artwork is as created
  • Cancellation: deposit is non-refundable

  1. SHIPPING AND DELIVERY

Processing Time:
Orders are typically processed and shipped within [SPECIFY PROCESSING TIME] business days.

Delivery Times:

  • Latvia: 2-5 business days
  • European Union: 4-20 business days
  • Rest of world: 7-30 business days

These are estimates and not guarantees. Delivery times may vary due to customs, holidays, or other factors beyond our control.

  1. RETURNS, REFUNDS, AND CANCELLATIONS

No Returns Policy:
Due to the unique, one-of-a-kind nature of our artwork, we do not accept returns for change of mind or buyer’s remorse.

Damaged Items Only:
We only accept returns for artwork that arrives damaged during shipping. Please see our Refund & Returns Policy for complete information.

Cancellations:
Orders cannot be cancelled once they have been shipped.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • We are not liable for any indirect, consequential, or incidental damages
  • Our total liability for any claim is limited to the amount you paid for the artwork
  • We are not responsible for delays caused by shipping carriers, customs, or events beyond our control
  • We are not liable for color variations due to monitor/screen differences

Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence.

  1. WARRANTIES AND DISCLAIMERS

Authenticity:
We guarantee that all artwork is original and created by Maria Pranka. Each piece comes with a certificate of authenticity.

Quality:
We carefully inspect all artwork before shipping and package it securely to prevent damage.

“As Is”:
Except as stated above, artwork is sold “as is” without any other warranties, express or implied.

  1. GOVERNING LAW

These Terms and Conditions are governed by the laws of Latvia. Any disputes arising from these terms or your use of our website will be subject to the exclusive jurisdiction of the courts of Latvia.
